Tne diainage w'.ll c.>ntinue <br />wetland." <br />11 t ie e -St t: 1 <br />Callahan a:iked if each neighbor on Woodhaven Drive wr)uid <br />have to come to the City for a Conditional Us'- Permit to correct <br />drainage problems that may occur if each neighbor feels it <br />necessary to haul in fill; in other words a domino effect. <br />Gaffron stated that the Cxty Engineer did not believe that <br />would occur. <br />Goetten asked whether the filling will actually improve the <br />drainage the situation. <br />Jean Richardson e.-cplained, "We have been advised to grade <br />the fill and slope i*- slightly between the two properties. Right <br />now that area is so low, water just sits there. The fill will <br />increase the elevation and grading will provide enough slope to <br />allow the drainage to flow from the property." <br />Gaffron added, "One could also argue that this is something <br />that should have been done by Mr. Levering when he graded the lot <br />after constructing Dr. Richardson's house. This issue was <br />obvious back in 1983 when drainage questions were raised by the <br />neighbors. The grading issue was nevar resolved to the <br />satisfaction of anyone." <br />Keenan Richardson stated that the area of stagnant water is <br />not only ugly, but poses a potential health problem. He said, <br />"It is roy understanding that, although tiiis pre-dates m/ <br />ownership of this property, that thi.s ponded area of standing <br />water has been ping-ponged back and forth between these two <br />properties. The City Engineer agrees that what we are now doing <br />will channel the water back into the wetland area. It is on that <br />basis that we would ask Council to reconsider the after-tho-fact <br />penalty faes. The City Engineer approved the proposal back in <br />1985 which caus«ad the run-off to drain onto my property." <br />It was moved by Callahan, seconded by Jabbour, to a>dopt <br />Resolution #2957, as presented by Staff, granting a Conditional <br />Use Permit for approximately 500 cubic yards of fill within the <br />front yard of Keenan and Jean Richardson's homo, located at 2500 <br />Noodhaven Drive, and including p'^.yment of penalty fees. All <br />voted aye. Motion passed. <br />- 10 -
