A RESOLUTION APPROVING <br />THE LEGAL COMBINATION OF <br />PROPERTIES LOCATED AT <br />365 AND 373 WESTLAKE STREET <br />WHEREAS, Joseph D. Fiedler and Mary B. Fiedler (hereinafter "applicants") are <br />the owners of properties located at 365 and 373 Westlake Street within the City of Orono <br />(hereinafter "City") legally described as: <br />Lot 18, Block 2, Hillside Park, Hennepin County, Minnesota (365 Westlake Street) <br />and <br />Lot 17, Block 2, Hillside Park, Hennepin County, Minnesota (373 Westlake Street); and <br />WHEREAS, each of Lots 17 and 18 contains a principal residence structure; and <br />WHEREAS, the applicants have requested City approval to legally combine said <br />Lots 17 and 18 for the purpose of constructing a new residence on the combined property in the <br />future; and <br />WHEREAS, Orono Zoning Code Section 10.03 Subdivision 7 allows only one <br />principal building per tax parcel, and the proposed legal combination would be in violation of the <br />Code unless one of the two residence structures is either removed or modified to become an <br />accessory structure; and <br />WHEREAS, the applicants have agreed to remove the plumbing from the residence <br />on Lot 17, thereby converting it from a principal building to an accessory structure; and <br />WHEREAS, the residence structure on Lot 17 upon its conversion to an accessor}’ <br />structure will be considered as non-conforming in location per Zoning Code Section 10.03 <br />Subdivision 9(D) because it is located nearer the street lot line than the remaining principal residence <br />on the property; and <br />1 <br />Page 1 of 4
