Gaffron <br />Title: Senior Planning Coordinator <br />Administrator Approval:Agenda Section: <br />Zoning <br />Item Description: #2369 - Joe & Mary Fiedler, 365-373 Westlake Street - <br />a)Lot Combination Resolution <br />b)Final Action: Request for Assessment Refund <br />List of Exhibits <br />A - Resolution <br />B - Draft Council Minutes 10-26-98 <br />C - Memo & Exhibits of 10-22-98 <br />October 26 Council Action <br />On October 26 Council voted 4-0 to approve the legal combination of 365-373 Westlake Street, <br />subject to the removal of plumbing from the building at 373 Westlake Street, accepting the existing <br />structure at 373 Westlake Street as an existing non-conforming accessory building due to its location <br />nearer the street than the pricipal residence, subject to the accessory building being removed within <br />two years. <br />After discussion. Council also voted 4-0 to table the request for a refund of the assessment paid off <br />for 373 Westlake by Fiedler in 1998, so that the full Council would be present to take action on the <br />request. <br />Staff Recommendation <br />1.Staff recommends that Council adopt the attached resolution with conditions regarding the <br />lot combination approval. <br />2.Staff recommends denial of the assessment refund as noted in the staff memo of October 22. <br />No resolution is necessary for such denial. <br />COUNCIL ACTION REQUESTED <br />Adopt the lot combination resolution and take final action on the assessment refund request.
