Kelly Cove Joint Use Dock <br />July 23. 1998 <br />Page 2 <br />The request has merit and might be considered for approval under the following <br />scenario: <br />1.Owner of Lot 3, Navarre Cove (Mo> t) must agree via covenant to a <br />limit of two boats for a single family residence on Lot 3. and formally <br />gives up the rights to ha\e a duplex on the property. Outlot A. Navarre <br />Cove and Lot 3 must then be legally combined, and KCHA's interests <br />in Outlot A and Lot 3 must be extinguished. <br />2.KCI lA must agree via covenant to limit the new docks to no more than <br />4 slips of a size (width and length) no greater than the existing slips, <br />and in a compact and defined location and configuration. <br />Council directed staff to schedule a public hearing on this matter and notify the neighboring <br />lakeshore property owners. StafThas sent mailed notice to all property owners abutting the lagoon. <br />Existing and Proposed Dock Layout <br />The existing dock system contains 3 docks with slips on either side for a total of 6 slips. The City <br />and LMCD permits have formally allowed a dock length of 44' since 1993 (increased from 25' <br />during the late '80s drought). The docks are separated by 22' and 28' respectively such that the <br />interior slips (2-3-4-S as shown on Exh. E-1 of the June 17 memo) could potentially accommodate <br />boats of 10-12' beam. The proposed new KCI IA slips are 32' deep and 13' wide, and start <br />approximately 24' from the shore, with a single access walkway from shore. The new dock system <br />is proposed to extend from just west of the midpoint of Kelly Cove Outlot A, more or less centered <br />on the KCHA site. <br />Staff is advised that some neighboring property owners may request that the dock system be <br />redesigned or relocated to have less impact on lagoon traffic. The owner of Lot 3 has not indicated <br />how a dock system would be configured to serve a single fa*'aily residence on Lot 3. <br />Consistency with Comprehensive Plan <br />The conditions under w hich Council suggested this new joint use dock license might be approved <br />appear to be consistent w ith the Orono Comprehensive Plan General Land Use Policies (CMP 4-13, <br />item 5) which states: <br />"5.PROTECTION OF LAKE RESOURCES WILL ALLOW RE.ASONABLE ACCESS. <br />USE AND ENJOYMENT WHILE PREVENTING OVERCROWDING AND EXCESSIVE <br />ENCROACHMENT. In conformance with MnDNR Shoreline Management regulations for <br />recreational development lakes, Orono will prohibit overly dense development within 1,000
