. * <br />Kelly Cove Joint Dock <br />Novembers, 19^8 <br />Page 2 <br />1, Owhl? ol Lot 3, Navarre Cove (Ho>1) must agree via covenant to a limit of two boats <br />for a single family residence on Lot 3, and formally give up the rights to have a duplex on <br />the property. Outlot A, Navarre Cove and Lot 3 must then be legally combined, and KCHA's <br />interests in Outlot A and Lot 3 must be extinguished. <br />2.KCHA must agree via covenant to limit the new docks to no more than 4 slips of a <br />size (width and length) no greater than the existing slips, and in a compact and defined <br />location and configuration. <br />3.Staff to notify neighborhood for a public hearing. <br />July 27 Council Action <br />On July 27 Council held a public hearing at which a number of interests were heard from. Rick <br />Sheridan represented Brad Hoyt. John Kupfer represented the Kelly Cove homeowners. Richard <br />Edwards spoke on behalf of a group of 6 property owners surrounding the lagoon, who requested <br />that the proposed dock be moved further east along the lagoon and closer to shore, which appeared <br />acceptable to the Kelly Cove group. <br />Please refer to the minutes of July 27 for more detail of the various topics discussed. Council again <br />confirmed that it is the Council's intent to limit Kelly Cove.'Navarre Cove properties to a total of 6 <br />slips, i.e. I slip for each of the 4 remaining duplexes, and 2 slips for the Hoyt property regardless <br />whether it becomes a single family home or a duplex. After discussion regarding the 60-day window <br />for City action on this request. Council voted 4*I to deny the request but allow the Kelly Cove <br />homeowners to re-apply at no charge if Mr. Hoyt reaches a conclusion on how he will develop his <br />property. <br />Current Status of Proposal <br />Austin Evans on behalf of the KCHA has submitted a dock plan with the following parameters: <br />-Location centered approximately 20' east from the original proposal, in the same <br />general configuration <br />Total length from shore reduced from 56' to 48' <br />Indl' idual slips have not changed from the initial proposal of 13' x 32’ <br />Rick Sheridan on behalf of Brad Hoyt has made the follow ing points in his letter: <br />His analysis of the background on how ’ the current dock system came about, is that <br />the issue was totally driven by presersation of wetlands. Since the wetlands in <br />question no longer exist, the reason for the common dock scheme is no longer <br />present. <br />-The documents creating the current dock scheme appai ently were not recorded Kells
