Cove Joint Dock <br />Nov ember 5, 1998 <br />Page 3 <br />acainst Lot 3. <br />Regardless of the above, Hoyt will agree to restrict the use of Lot 3 to 2 slips. <br />Issues that staff sees as unresolved as of this writing; <br />Will the proposed dock layout alleviate concerns of the other users of the lagoon? <br />How will Hoyt's dock be located/configured? (sketch pending) <br />Will Ho>'t ’s property become a single family site or a duplex site? Does this matter, <br />given his agreement to limit Lot 3 to just 2 slips? <br />-WTiat should become of the wetland easement, if anything? <br />Compliance with City Code Standards <br />As noted in the June 17 memo, the proposed 4-slip joint use dock meets the standards established <br />for such uses in Municipal Code Section 5.42, i.e. it results in no more than 1 boat slip per 50' of <br />shoreline as measured in a straight line (approximately 220'), and does not require additional parking <br />or new hardcover. Further, there will be no negative impacts on the adjacent land area which, <br />although covered under a wetland easement since 1979, does not have the characteristics of a <br />wetland. <br />Lot 3 would have a defined width of approximately 150 ’ once Outlot A, Navarre Cove is combined <br />with it. This would also meet the l-slip-per-50' stanaard for a 2-slip dock. <br />Staff Recommendation <br />If it is concluded that the location and configuration of Hoyt's proposed dock will not create any new <br />impa cts on boat traffic in the lagoon, and if Council and the surrounding affected lagoon users <br />conclude that the proposed KCHA dock layout and location will not impede lagoon traffic, staff <br />would recommend approval of a separate 4-slip dock system for KCHA and a 2 slip dock for Lot <br />3, regardless whether Lot 3 becomes a duplex or single-family site. Such approval should be subject <br />to appropriate legal documentation, likely including (but not limited to): <br />Issuance of a joint use dock license to KCHA, including a resolution defining the <br />basis for approval; <br />Modification of the Conserv ation and Flowage Easement to allow dock construction; <br />Amendment of the conditions of City approvals for the plats ot Navarre Cove <br />and Kelly Cove if City Aitorney deems necessary; <br />-Appropriate documentation separating KCHA from Navarre Cove Association, <br />including removal of easement over Lot 3 and Outlot A. Navarre Cove; <br />Legal combination of Outlot A and Lot 3, <br />Covenants to be executed by Hoyt limiting Lot 3 to 2 slips; <br />KCHA to e.xecute covenants agreeing to no more than 4 slips.
