It was noted <br />that the ordinance language does not strictly follow the language in the statutes, and that the criteria <br />for interim uses should be spelled out. <br />In order that discussions on this proposed amendment continue, staff is suggesting revisions to the <br />criteria establishing applicability of the ordinance (Subd. 4, page 2): <br />Subd. 4. Interim Uses: Limitation on Applicability. This ordinance shall apply only <br />to properties that: <br />a.abut existing U.S. Highway 12 that contain an existing building in which the <br />interim use will occur.: or and <br />b. cither will abut future Highway 12 or in which the existing building will be <br />partially or fully acquired for future Highway 12 right-of wav: and <br />for which the Council determines that no other use would be financially <br />isasiblfi^ <br />These revisions restrict the applicability of the ordinance to a relatively small number of properties <br />that will be acquired by MNDot for Highway 12. The scope of the resulting ordinance is extremely <br />limited, but still gives Council wide latitude in determining suitable short-term options for the few <br />sites to which the ordinance applies. <br />The "Purpose" statement has been redrafted and shortened to more directly pertain to the reasons for <br />this ordinance in the context of Highway 12.
