1998 Marina Licenses <br />August?, 1998 <br />Page 5 <br />E. Lakeside Marina <br />Lakeside Marina has 77 rental slips on Maxwell Bay. This is a full-service operation that <br />includes a boat club, repair shop, ship's store, boat brokerage, charter boats berthed at *e site <br />and sometimes using it as a port-of-call, and to a limited extent on-demand launching of <br />customer boats stored on site, as well as transient launching when space is available. <br />Lakeside's 1995, 1996,1997 and 1998 license applications each indicate that all of the five <br />activities requiring a CUP under the 1995 B-2 Code revisions, are or will be occurring on fte <br />site An incomplete CUP application with $300 fee was submitted by Mr. Dunn on May 31, <br />1996 Staff has had numerous contacts with Dunn since then detailing the necess^ <br />submittals to make the application complete. He has indicated his attorney has advised tarn <br />to not make the CUP application, and we have requested that the City Attorney discuss this <br />matter with Dunn's attorney. <br />Those items which require ongoing attention by the marina operator in order to remain in <br />compliance include managing parking in order to avoid congestion on the site, management <br />of boat storage to avoid causing view obstructions for traffic entering and leaving e si , <br />and limiting storage to those locations shown on the site operation plan. <br />The City received a written complaint against Lakeside Marina on July 28,1998 from the <br />adjacent property owner, Robert Waade (copy attached). The specific problems noted relate <br />to a lack of compliance with two of the seven operation standards, and include. <br />Standard #1. Lakeside tenants/customers using the Waade property as if it is part <br />of the marina, i.e. walking, playing, working on boats, walking dogs, temporary <br />trailer and auto parking, wood and debris being left, etc. <br />Standard #7. Site lighting that shines outside the marina properly boundaries. <br />The neighboring property orvner has reques.ed that the City enforce its “'din^ces in <br />regards to the above as well as to the requirements for appropriate speofi > <br />provision of a fence along the property line. Code section Subd. 10, <br />landscaping requirements for marinas, and Dunn has acknowledged that Lakeside has lo g <br />been out of compliance with the standards as regards its east lot line but has J <br />e.xpressed an intent to comply when the fate of the adjacent property is finally decided. Th <br />day has now come, and Dunn has recently indicated to staff an intent to <br />work happening Nvithin 30 days. 1 have asked for a plan of what he intends and he indicates <br />he will comply with the plans established in the late 70's/early 80's (attached).
