1998 Marina Licenses <br />August 5, 1998 <br />Page 6 <br />That plan does not include a fence as requested by Waade. Such a fence can be required <br />per Subd. 10 and under the current code standards could be up to 6' in height along the side <br />property line, except no fence would be allowed within 75' of the shoreline and no higher <br />than 3-1/2' in height within the defined 30' front yard, unless required by the Council. In <br />discussions with Waade, he has indicated a 6' fence on a 3' berm centered on the property line <br />would provide the screening and security he desires. However, he has been unable to reach <br />an agreement with Dunn regarding such a berm. Therefore, we expect a berm with plantings <br />on it will be constructed by Waade as part of the site improvements for his subdivision. <br />Waade has also noted a concern regarding encroachment of extended lot lines (dock use area) <br />by boats owned by or docked at the marina. Greg Nybeck of the LMCD has indicated they <br />will be following up on this issue. It would appear that once a home is built on Waade's <br />lakeshore lot, Waade could legally put in a dock that would significantly hinder use of <br />Lakeside's docks, i.e. Lakeside's dock layout essentially forces the slip customers to drive <br />across Waade's dock use area. <br />Staff Recommendation <br />1 . Council should consider whether a fence should be required along Lakeside's east <br />boundary, and if so, how high, what design (to merely prohibit trespass or to also provide <br />screening) and to what extent within the 0-75' zone or within the 30' street yard. <br />2. If Council does not wish to require the construction of a fence. Council should condition <br />the granting of a 1998 license on successful completion of a suitable landscapi ”® plan <br />meeting the standards of Section 10.41 Subd. 10. A deadline for completion i be <br />established (30-60 days?). <br />3. A condition of license approval should be that lighting be relocated, redirected or shielded <br />so that the source of light is not visible from the adjacent property. Establish a deadline for <br />this also. <br />Staff recommends that Lakeside be issued a license for 1998 which incorporates conditions <br />regarding fence, landscaping and lighting, and deadlines for completion. <br />Stafl* Recommendation <br />Staff recommends approval of 1998 commercial marina licenses for Windward Marina, <br />Geumar/King's Cove, Sailor's World, North Shore Marina and a license with conditions for Lakeside <br />Marina.
