A RESOLUTION GRANTING A VARIANCE <br />TO MUNICIPAL ZONING CODE <br />SECTION 10.22, SUED. 2 AND <br />SECTION 10.56, SUED. 16 (L) 1 AND 2 <br />FILE NO. #2380 <br />WHEREAS, Richard and Kathy Kyle (hereinafter "the applicants") are the <br />ovvners of the property located at 1140 Tonkawa Road within the City of Orono (hereinafter <br />the City”) and legally described as follows: <br />Exhibit A attached, Hennepin County, MN (hereinafter "the property"); and <br />WIffiREAS, after due published and mailed notice in accordance with Minnesota <br />Sta^tes and the City of Orono Zoning and Planning Codes, the Orono Planning Commission <br />held a public hearing on June 15, 1998, at which time all persons desiring to be heard <br />concermng this application were given the opportunity to speak thereon; and <br />i-. j the applicants have applied to the City for variances to Municipal Zoning <br />Code Section 10.22, Subd. 2 and Section 10.56, Subd. 16 (L) 1 and 2 to permit a second stoiy <br />addition to an existing residence that is located in the 0-75' setback where variances for <br />hardcover, lakeshore setback and average lakeshore setback are required. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono. <br />Minnesota: <br />FINDINGS .. <br />3. <br />This application was reviewed as Zoning File #2380. <br />The property is located in the LR-IB Single Family Lakeshore Residential <br />Zoning District, where 1 acre or 43,560 sq. ft. minimum lot area is required. <br />The property consists of .62 acre or 27,186 sq. ft. <br />The Orono Planning Commission reviewed this application on June 15, 1998 and <br />recommended approval by a vote of 7 to 0. <br />The Planning Commission made the following findings of fact: <br />Page 1 of 6
