5. <br />A. The subject property does not meet the lot area or lot \vidUi requirements <br />for the LR-IB district. <br />B. The existing residence was built in 1960 and is located 36' from the <br />929.4' elevation of Lake Minnetonka. <br />C. The existing residence is located approximately 17 ’ lakeward of the <br />average lakeshore setback. <br />D. The existing residence does not exceed the 15% lot coverage requirement. <br />E. The existing hardcover exceeds the amount of hardcover allowed in the <br />0-75' setback (38.42%) and 75-250 ’ setback (43.47%). <br />The City Council finds that the conditions existing on this property are peculiar <br />to it and do not apply generally to other property in this zoning district; that <br />granting the variances would not adversely affect traffic conditions, light, air nor <br />pose a fire hazard or other danger to neighboring property; would not merely <br />serve as a convenience to the applicants, but is necessary to alleviate a <br />demonstrable hardship or ifficulty; is necessary to preserve a substantial <br />property right of the a;p cants; and would be in keeping with the spirit and <br />intent of the Zoning Code and Comprehensive Plan of the City. <br />The City Council has considered this application including the findings and <br />recommendations of the Planning Commission, reports by City staff, comments <br />by the applicants and the effect of the .proposed variance on the health, safety <br />and welfare of the community. <br />CONCLUSIONS, ORDER AND CONDITIONS <br />Based upon one or more of the above findings, the Orono City i juncil hereby <br />grants variances to Municipal Zoning Code Section 10.22, Subd. 2 and Section 10.56, Sub . <br />16 (L) 1 and 2 to permit a second story addition to tlie existing residence. Approval is su jec <br />to the following conditions; <br />1. In the 0-75' setback, the shed, patio block by deck, ^ ^ <br />removed as shown in Exhibit B, to reduce hardcover from 38.42 /o to 25.80 /o. <br />6. <br />Page 2 of 6
