il'Wi <br />Zoning File #1615 <br />February 4, 1991 <br />Page 6 <br />Additional Comments and Planning Commission Recommendation - <br />The applicants' surveyor provided an amended preliminary <br />plan (Exhibit L) at the Planning Commission's public hearing <br />confirming Lot 2's dry buildable land at 2.11 acres. The plan <br />also relocated the septic envelope and building envelope fot" Lot <br />1 per staff's direction. Please note the Planning Com.missicn <br />recommendation did not include sewer and water to Lot 1, and <br />preferred that the matter be addressed by the Council. It is <br />staff's understanding that the applicants will formally recuest <br />sewer and water to Lot 1 before the Council. <br />As for serving Lot 1 with municipal water and sewer, staff <br />unanimously recommends providing municipal services to Lot 1 <br />based on the following findings: <br />1. Applicants' subdivision proposal has been based on <br />existj.ng standards of the RR—IB rural zoning district. <br />2. Applicants' on-site evaluator has confirmed reconfirmed <br />by Mike Gaffron that Lot 1 can be developed with on-site <br />septic. <br />3. Sewer and water lines will be installed within Outlet A <br />to serve Lot 2. The sewering of Lot 1 will not involve any <br />greater impact on the wetland area. In fact, extensions to <br />Lot 1 will be located out of the protected wetland area. <br />The City of Wayzata has asked that if sewer and water is <br />approved for Lot 1 that permits be obtained from Wayzata offices. <br />In turn sewer and water permits would be issued by the City of <br />Orono for Lot 2. As the lines connecting both houses to <br />municipal services would be via Orono sewer and water lines <br />within Ferndale Green. It is not clear to staff why Wayzata must <br />issue permits to Lot 2. Staff will meet the week of February 4th <br />to resolve this matter. Staff will report to Council as to the <br />final resolve of this matter between the Cities. <br />As for the building permit for Lot 1, based on the final <br />location of the house in relation to the municipal boundary line, <br />a percentage of the building permit for Lot 1 will be given to <br />the City of Wayzata. The City already has agreements in place as <br />to the regular billing of the sewer and water use. Once <br />installed, both homes will be billed by the City of Orono.
