a) Approximately two-thirds of the existing residence is <br />located in the 0-75' lakeshore setback zone. Portions of <br />the existing driveway are also located in the 0-75' setback <br />zone. A variance to allow this house location was approved <br />by the City Council on May 13, 1974. <br />b) The construction of a second story addition above the <br />existing residence but located entirely within the existing <br />footprint of the building, will not have a detrimental <br />effect on the character of the neighborhood nor <br />significantly impact the visual character of the shoreline <br />as viewed from the lake. <br />c) The existing 70' encroachment past the average setback <br />line will be extended upward, however, because of the <br />protruding nature of the shoreline, neither neighboring <br />property will have existing lake views decreased by such <br />upward encroachment, nor by the garage and pool additions. <br />d) In conjunction with removals of driveway and landscaping <br />hardcover, hardcover in the 0-75' zone will decrease from <br />36% down to 31.7%. Further, proposed additions in the 75- <br />250' zone are generally over existing hardcover, and will <br />result in no net increase in hardcover above the currently <br />existing 38% in the 75-250' zone. <br />4. The City Council has considered this application including <br />the findings and recommendations of the Planning Commission, <br />reports by City staff, comments by the applicant and the effect <br />of the proposed variance on the health, safety and welfare of the <br />community. <br />5. The City Council finds that the conditions existing on this <br />property are peculiar to it and do not apply generally to other <br />property in this zoning district; that granting the variance <br />would not adversely affect traffic conditions, light, air nor <br />pose a fire hazard or other danger to neighboring property; would <br />not merely serve as a convenience to the applicant, but is <br />necessary to alleviate a demonstrable hardship or difficulty; is <br />necessary to preserve a substantial property right of the <br />applicant; and would be in keeping with the spirit and intent of <br />the Zoning Code and Comprehensive Plan of the City. <br />Page 2 of 5
