CONCI.OSIONS, ORDER AND CONDITIONS <br />Based upon the above findings, the Orono City Council hereby <br />grants a variance to the Municipal Zoning Code Sections 10.22, <br />Subdivisions 1 and 2 and 10.55, Subdivision 8 to permit the <br />construction of additions to the existing residence, including a <br />second story above a portion of the existing house, pool, and attached <br />garage, such additions encroaching past the average lakeshore setback <br />where no encroachment is normally allowed, such construction <br />comprising hardcover and structure in the 0-75' lakeshore setback zone <br />where no hardcover or structure is normally allowed, and comprising <br />hardcover in excess of the 25% hardcover normally allowed in the 75“ <br />250* setback zone, subject to the following conditions; <br />X. Hardcover in the 0-75* zone is approved at a level of 31.7%. <br />Hardcover in the 75-250' zone is approved at a level of 38%. All <br />existing and proposed hardcover approved for this variance <br />approval is recorded in the calculation worksheet and diagram <br />attached to this resolution as Exhibit A. The current property <br />owner and all future owners of this property are placed on notice <br />that hardcover shall not be increased above the currently <br />approved level and any proposed improvements of this property <br />that will result in additional hardcover must be approved by the <br />City. Such approval may result in a requirement for concurrent <br />equivalent or greater removals of existing hardcover. All <br />existing hardcover scheduled for removal as a condition of this <br />resolution must be removed prior to the footing inspection for <br />the new construction. <br />2. Applicants shall adhere to the approved plans, and any. <br />changes to those plans shall be subject to further City review. <br />3. The proposed lower garage floor shall be raised to meet the <br />required 932.5* regulatory flood protection elevation. Applicant <br />shall revise construction plans for the garage addition to <br />accomodate this requirement, and shall provide elevations and a <br />grading plan for staff review prior to issuance of the building <br />permit. <br />4. Authorities granted by this variance run with the property <br />not with the applicant, but are permissive only and must be <br />exercised by application for a building permit within one year of <br />the date of Council approval, or this variance will expire on <br />that date (February 11, 1992). <br />Page 3 of 5 <br />L '.^.,
