A RESOLUTION GRANTING <br />A VARIANCE TO <br />NUNICIPAL ZONING CODE <br />SECTIOrS 10.22, SUBDIVISIONS 1 & 2 <br />AND SECTION 10.55, SUBDIVISION 8 <br />PILE #1605 <br />WHEREAS, Dr. Richard Lindstrom (hereinafter "the applicant") <br />is the owner of the property located at 1065 West Ferndale Road <br />within the City of Orono (hereinafter "City") and legally described as <br />follows: <br />Tract A, Registered Land Survey No. 1372, Hennepin County, <br />Minnesota (hereinafter "the property"); and <br />WHEREAS, the applicant has applied to the City for a <br />variance to Municipal Zoning Code Section 10.22, Subdivisions 1 and 2 <br />and Section 10.55, Subdivision 8, to allow construction of additions <br />to an existing residence, such additions being located within the <br />75* lakeshore setback zone where no structures are normally allowed, <br />and requesting a variance for hardcover in the 0-75' and 75-250' <br />lakeshore setback zones for hardcover in excess of the amounts <br />normally allowed, and requesting a variance for additional structure <br />to be located lakeward of the average laJceshore setback line where no <br />encroachment is normally allowed. <br />NOW, TBBRBFORE, BE IT RESOLVED by the City Council of Orono, <br />Minnesota: <br />FINDINGS <br />1. This application was reviewed as Zoning Pile #1605 <br />2. The property is located in the LR-IA Single Family Lakeshore <br />Residential Zoning District. <br />3. The Orono Planning Commission reviewed this application on <br />November 19, 1990 and tabled the request to allow applicant the <br />opportunity to revise the proposal to more closely meet the City <br />requirements. The revised application was reviewed by the <br />Planning Commission on January 22, 1991, at which time the <br />Planning Commission recommended approval of the proposed variance <br />as revised, based upon the following findings: <br />Page 1 of 5
