<br /> In having gotten to this point of the project, please let me assure the City Council and City
<br /> Planning Department that this was not a deliberate gesture of contempt or disregard for City
<br /> Code. In sincere honesty, it was an effect of misinterpretation of City Code with respect to
<br /> entrance gates defaulting to the guidelines of common yard fencing, and that the word "fence" in
<br /> this instance is synonymous with the word "gate." In having further seen City Code parameters
<br /> in the design for entrance monuments, with the height allowance of eight feet including"any
<br /> appurtenances," it was interpreted in the design that gates should not exceed this stated height as
<br /> an apparatus of the entrance monument.
<br /> There were also instances of taller gates readily seen in the near vicinity of this property that lead
<br /> to this interpretation. Here are some of the examples of gates that were seen in the
