CITYof ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. ^ <br />3. The Orono Planning Commission reviewed this application <br />on August 17, 1992, and recommended approval of the <br />proposed variances based upon the following findings: <br />A. The property is approximately one-third acre in <br />area and subject to 2 acre development standards. <br />« <br />B. The lot is typical in size of the developed <br />surrounding Crystal Bay neighborhood properties. <br />C. A residence has existed on the property since the <br />early 1940's. <br />D. The property is served with sewer and has been <br />assessed a single sewer unit. <br />4. The City Council finds that the conditions existing on <br />this property are peculiar to t and do not apply <br />generally to other property n this zoning district; <br />that granting the variance would not adversely affect <br />traffic conditions, light, air nor pose a fire hazard <br />or other danger to neighboring property; would not <br />merely serve as a convenience to the applicant, but is <br />necessary to alleviate a demonstrable hardship or <br />difficulty; is necessary to preserve a substantial <br />property right of the applicant; and would be in <br />keeping with the spirit and intent of the Zoning Code <br />and Comprehensive Plan of the City. <br />5. The City Council has considered this application <br />including the findings and recommendations of the <br />Planning Commission, reports by City staff, comments by <br />the applicant and the effect of the variances on the <br />health, safety and welfare of the community. <br />CONCLUSIONS, ORDER AND CONDITIONS <br />Based upon one or more of tne above findings, the Orono <br />City Council hereby grants variances to Municipal Zoning Code <br />Section 10.28, Subdivision 5 (B) to permit the construction of a <br />new residence structure that will require a^i area variance of <br />71,018.4 s.f., 1.63 acres or 81%, a width variance of 170' or <br />53.5%, an east side setback variance of 10' or 33.3%, a west side <br />variance of 13' or 43.3% and a rear setback variance of 31' 6" or <br />64%.
