MIHIIEHAHA CREEK WATERSHED DISTRICT <br />GLEASON CREEK HATER MANAGEMENT PROJECT <br />RESOLUTION RECEIVING AMENDED ENGINEERS REPORT. DETERMIHINv* <br />BENEFITS AND DAMAGES AMD ORDERING A FINAL PUBLIC HEARING <br />DATED JULY 16. 1992 <br />WHEREAS, the City of Wayzata, by Amended Petition dated <br />March 18. 1992. requested the District to undertake the Gleason <br />Creek Water Management Project; and <br />WHEREAS. Engineers for the Minnehaha Creek Watershed <br />District have completed their report required under Minnesota <br />Statute Section 103D.711, which sets out the project plan for the <br />und6rtakinQ of tho Gl©3Son Crook Wator ManaQORiont Projoct# and <br />WHEREAS, the Managers received this report from the <br />Engiheers on April 16, 1992, and finding the project part of the <br />basic water management features of the Overall Plan of the <br />watershed District and eligible for general levy financing in <br />accordance with Minnesota Statute Section 103D.905, subd. 3. <br />referred the report to the Board of Water and Soil Resources and <br />the Director of the Division of Waters of the Department of <br />Natural Resources; and <br />WHEREAS, the District has received an advisory report from <br />the Director c." the Division of Waters of the Department of <br />Natural Resources regarding the Gleason Creek Water Management <br />Project and the time period for receipt of an advisory report from <br />the Board of Water and Soil Resources has expired pursuant to <br />Minnesota Statutes Section 103D.711. subd. 5; and <br />WHEREAS, the Engineers have prepared an amended report on <br />the Gleason Creek Water Management Project to provide the Manaprs <br />with more information on minor project modifications and impacts <br />of the Gleason Creek Water Management Project; and <br />WHEREAS, the Managers have elected to determine benefits <br />and damages to the property affected by the project with the <br />assistance of the Engineers pursuant to Minnesota Statutes Sect^n <br />103D.721, and have determined, pursuant to Section 103D.721. subd. <br />4, that the District’s share of costs for the Gl* ison Creek Water <br />Management Project is attributable entirely to the basic water <br />management features of the improvement project and should be <br />generally assessed by the District; and <br />WHEREAS, the Managers with the assistance of the Engineer <br />have determined that the Gleason Creek Water Management Project <br />may affect owners of property adjacent to Gleason Lake by causing <br />an intermittent increase in the water level of Gleason Lake, and <br />therefore flowage easements will need to be acquired.
