MINUTES OF THE LAKE USE COMMITTEE - August 12, 1992^ ~ _I ’ - <br />iii L'U Lm it <br />The meetina of the Lake Use Committee of the City of Orono <br />was held pursuant to noti-e at 7:45 a.m.« Wednesday, August 12, <br />1992 at the Orono Council Chambers. Chairman Ed Callahan, <br />Gabriel Jabbour, J. Diann Goetten, Charles Kelley and Charles <br />Schroeder of the Committee and staff members Mike Gaffron and <br />Jeanne Mabusth were present. Mark and Debbie Breneman, Jim Dunn <br />and Beth Whittaker were present representing area marinas. <br />The minutes of the Lake Use Committee meetings of June 24, <br />1992 and July 8, 1992 were approved. <br />Chairman Callahan referred to the packet regarding licenses <br />for North Drive Marina and Lakeside Marina. It was the <br />recommendation of staff to grant licenses to these two marinas <br />back to 1991. Although Gayles Marina was not reviewed at this <br />time, it could be presumed there would also be a recommendation <br />for approval of their license. Jabbour agreed with the staff <br />recommendation, however, Callahan felt the licenses should be <br />denied. He referred to the staff recommendation in the Lakeside <br />Marina memo, "Staff finds questionable valie in further denial or <br />withholding of a license for ....". He said, without being <br />critical of staff, that staff wanted to approve these because <br />they don't know what else to do. Jabbour asked if the denial was <br />based on existing ordinances. Callahan replied that it was based <br />upon the that fact if we reject the licenses and then try to <br />enforce the operation without licenses that it will create a <br />fight and we shouldn't do that, so what we ought to do is uell <br />them to be good next year and we will let them by this year. <br />It has been the position of the City that the three maiinas <br />in question are not in compliance with licensing requirements. <br />North Shore Drive Marina has been working on changes but still <br />have violations in some areas. It is staff's view that Lakeside <br />Marina does not intend ho reduce the number of boats to the <br />licensing requirement along with other rhings stated in the May <br />28, 1992 letter. Callahan feels that since violations exist, <br />there is no purpose served and it would be improper to give a <br />license to these marinas. <br />Gaffron wanted to review issues regarding each marina. <br />Callahan stated there was a simpler way and asked if there were <br />violations. Gaffron responded that it depended <br />interepretation of code. There is no question that ther- <br />many parts of the code they do not comply with. Callahan state! <br />since this is true and there are violations, no license should be <br />given. The question of tagging is a separate issue. It does not <br />seem licenses should be given for something that they have <br />already done since they have already operated marinas in 1991. <br />Callahan asked if everyone agreed that if the marina is in <br />violation, no license should be issued. <br />Goetten concurred that if someone is trying to work out th- <br />situation, that is not enough to give them the license. She <br />asked Gaffron to continue discussion of the staff recommendation <br />I •
