Review of Flexibility Request <br />Page (2) <br />3. Elimination of the setback requirement for a specific <br />type of water oriented accessory structure. The city is <br />asking for flexibility to allow lock boxes (used to store <br />boat and beach equipment) which are limited to 20 square <br />feet in area and 48 inches in height to be setback <br />anywhere within the shore impact zone. The statewide <br />standards require that any water oriented accessory <br />g^j^\j[ctures located within the shore impact ^one ^ be <br />gg'tback at least 10 feet landward of the ordinary high <br />water level of any public waters. <br />4. Relaxation of the statewide standards requiring that <br />impervious cover in the shoreland area be limited to 25%. <br />The city i- stating that it will prohibit any impervious <br />cover, witi» the exception of the 20 square foot lock box <br />described above, and stairways not exceeding 4 feet in <br />width, in the first 75 feet of shoreland landward of the <br />ordinary high water level. The statcvide minimum of 25 <br />% impervious cover wou?d be allowed in the next 250 feet. <br />The city is then requesting that it be allowed to <br />increase the impervious limit up to 30% in the area <br />located from 250 feet to 500 feet landward, and up to 35% <br />impervious cover for all remaining shoreland located more <br />than 500 feet landward of the ordinary high water level <br />of the pul lie waters. The maximum allowable impervious <br />surface coverage under the "old** state shoreland rules <br />was 30%. <br />Orono has presented its requests for review DNR ^i^th its city <br />staff and representatives of 11 Lake Minnetonka cities who <br />working together as a Technical Review Committee for the purpose of <br />reviewing and discussing Lake Minnetorka flexibility requests.
