In accordance with the rules, the Commissioner and the city <br />must solicit the input and approval of other governmental bodies <br />that could be affected or impacted by the alternate controls. The <br />city and the DNR are asking that you provide your review and <br />ccmiDents, if any, to either DTTR or the city within 4 5 days of the <br />date of this letter. If no response is received prior to then, we <br />will assume that your city has no concerns with the neighboring <br />city's proposal. <br />The City of Orono is requesting flexibility from the following <br />statewide standards: <br />1. Reduction of setbacks from city streets and roads. The <br />statewide standards require 20 foot setbacks whereas the <br />city has allowed up to 10 foot setbacks in existing <br />development. Thus, if flexibility from this standard is <br />not allowed, many ejcisting structures would become <br />nonconforming structures. <br />2. Increase in the structure heicht limit. Statewide <br />standards require that a 25 foot height limit be applied <br />to all new structures in residential land use districts <br />in cities. The city is requesting the use of flexibility <br />to allow structures a height limit of 30 feet in <br />residential land use districts, again to keep many <br />existing residences already constructed above the 25 foot <br />limit from becoming nonconforming structures. The <br />maximum allowable structure height under the "old" state <br />shoreland rules v. \s 3 5 feet.
