The <br /> proposed residence addition will result in a home that is similar in scope to <br /> other homes in the immediate neighborhood on small lots with substandard <br /> setbacks and will not alter the character of the locality. <br /> h. The Applicants' request is in harmony with the purpose and intent of the <br /> ordinance. <br /> i. The Applicants have demonstrated that enforcing the provisions of the Zoning <br /> Ordinance deprives the Applicants of the reasonable use of their Property. <br /> j. Due to the lack of information about the ability of the existing foundation to <br /> support a second story, the foundation should be certified by a structural <br /> engineer prior to issuance of a building permit and corrections made if <br /> necessary. <br /> 4. The City Council has considered this application including the findings and <br /> recommendation of the Planning Commission, reports by City staff, comments by <br /> the Applicants and the public, and the effect of the proposed variances on the <br /> health, safety and welfare of the community. <br /> 5. The City Council finds that the conditions existing on this Property are peculiar to <br /> it and do not apply generally to other property in this zoning district; that granting <br /> the variances would not adversely affect traffic conditions, light, air nor pose a <br /> fire hazard or other danger to neighboring property; would not merely serve as a <br /> convenience to the Applicants, but are necessary to alleviate a practical difficulty; <br /> are necessary to preserve a substantial property right of the Applicants; and would <br /> be in keeping with the spirit and intent of the Zoning Code and Comprehensive <br /> Plan of the City. <br /> CONCLUSIONS, ORDER AND CONDITIONS <br /> Based upon one or more of the above findings, the Orono City Council hereby grants <br /> variances to Orono Municipal Zoning Code Section 78-305 to allow construction of a second <br /> story addition above the existing residence on a lot of 4,975 s.f. in area where a lot area of <br /> 87,120 s.f. is normally required, and of width 50' at the 929.4' shoreline contour and at the 75' <br /> setback line where a lot width of 200' is normally required, and with side setbacks of 13.9' and <br /> 15.7' from the east and west lot lines respectively, where side setbacks of 30' are normally <br /> required; and grants a variance to Section 78-1279(1) to allow construction of a second story <br /> addition above the existing residence 52' from the OHW of Lake Minnetonka where a 75' <br /> Page 3 of 5 <br />
