This application was reviewed as Zoning File number 14-3667. <br /> , 2. The Property is located in the LR-lA One Family Lakeshore Residential Zoning <br /> District which requires a minimum lot area of 2.0 acres and a minimum lot width <br /> of 200'. <br /> 3. The Planning Commission reviewed this application at a public hearing held on <br /> May 19, 2014 and voted 7 for and 0 against on a motion to approve the requested <br /> variances subject to certain conditions and based on the following findings: <br /> a. The Property contains 4,975 square feet in area and has a defined width of 50 <br /> feet at the 929.4' OHW contour for Lake Minnetonka and at the 75-foot <br /> setback line. <br /> b. The existing residence structure is 20'x28', one story with some attic space <br /> and no basement. The request is to add a second story directly above the <br /> existing main level. This would be consistent with a number of past additions <br /> approved on Eastlake Street. <br /> c. The existing residence structure is connected to municipal sewer. <br /> d. Adding a second story to the existing residence structure will not increase <br /> hardcover on the property and will not further reduce the existing substandard <br /> setbacks from the lake or property boundaries. It will increase the visual bulk <br /> and massing within the substandard setbacks, but not to the extent that it will <br /> be out of character with homes in the neighborhood. <br /> e. Because the 929.4' Lake Minnetonka OHW contour extends a few hundred <br /> feet up the creek based on surveys on file, the majority of the subject property <br /> is unbuildable as all but the front 25' is located within 75' of the OHW level. <br /> This creates a practical difficulty for any modifications to the property. <br /> f. Because the required side, front and rear/lake setbacks overlap, the site has no <br /> functional buildable envelope. The only opportunity for expansion without <br /> additional footprint encroachments is above the existing structure. <br /> g. Planning Commission finds that the property owner proposes to use the <br /> property in a reasonable manner, i.e. for residential purposes, in a manner <br /> similar to other homes on the block, on a parcel similar in size to others in the <br /> immediate neighborhood.
