� o� <br /> O � O CITY of ORONO <br /> . <br /> � � - � RESOLUTION OF THE CITY COUNCIL <br /> �'� �f� �,� No. 6409 <br /> t�k'ESH��'� <br /> setback is normally required; and grants variances to Orono Municipal Zoning Code Sections 78- <br /> 305 and 78-1279(2) to allow construction of a second story addition above the existing residence <br /> at a setback of 19.8' from the street lot line where a 50' setback is normally required by the LR- <br /> lA District Standards and a 30' setback is normally required by the Shoreland Overlay District <br /> standards; subject to the following conditions: <br /> 1. Council approval is based on the survey submitted by the Applicants and annotated by <br /> City staff, attached to this Resolution as Exhibit A. Any amendments to the site plan <br /> which are not in conformity with City codes will require further Planning Commission <br /> and City Council review. <br /> 2. Approval is based on the preliminary floor plans and elevation view submitted by <br /> .applicant and attached hereto as Exhibit B, which depict a 2-story home of <br /> approximately 26' peak height. Any substantial revisions to the bulk of the addition may <br /> require further City review. <br /> 3. Prior to issuance of a building permit, applicants shall provide certification from a <br /> structural engineer that the foundation can support a second story, or provide plans for a <br /> suitable foundation. In the event the foundation requires total replacement, further <br /> Council review will be required if the building footprint, height, setbacks or building <br /> envelope are changed as a result. <br /> 4. Authorities granted by this resolution run with the properiy not with the Applicants, but <br /> are permissive only and must be exercised by obtaining a building permit for the <br /> addition. A framing inspection must be completed within one year of the date of Council <br /> approval, or the variances granted herein will expire on that date (June 9, 2015). <br /> . 5. Violation of or non-compliance with any of the terms and conditions of this resolution <br /> shall constitute a violation of the zoning code, shall automatically terminate any authority <br /> granted herein, and shall be punishable as a misdemeanor. <br /> 6. The undersigned Applicants have read, understand and hereby agree to the terms of this <br /> resolution and on behalf of the Applicants and the Applicants' heirs, successors and <br /> assigns, hereby agree to the recording of this resolution in the chain of title of the <br /> Property. <br /> Page 4 of 5 <br />
