Deep- <br />haven, for a length variance to allow construction and mainte­ <br />nance of a 511 foot dock across a wetlands to reach open naviga­ <br />ble water. <br />MOTION: Foster moved, Grathwol seconded, to recommend <br />approval of the Order and attached Memorandum granting Ronald <br />Whinnery, 19780 Cottagewood Road, Deephaven, a variance from the <br />requirements of the LMCD Code in accordance with the plan submit­ <br />ted . <br />VOTE: Motion carried, Rascop voting nay <br />5.Multiple Dock License Renewals <br />A. Renewals Without Change <br />MOTION: Grathwol moved, Cochran <br />approval of the following renewal without <br />1992 with orders, stipulations: <br />1. Baycliffe Property Owners Assn., <br />2. Wayzata Yacht Club, Site 1 and 2 <br />to a valid Conditional Use Permit being <br />of Wayzata <br />VOTE: Motion carried unanimously. <br />seconded, to recommend <br />change applications for <br />Smithtown Ba.v <br />, Wayzata Bay sul)ject <br />in effect from the City <br />B. Renewals With Change: <br />1. Curly's Minnetonka Marina, Inc.Lower Lake South <br />the <br />west <br />Thibault reported that when Curly’s dock was inspected in <br />summer of 1991 it was determined that the 15 slips on the <br />side do not conform to the licensed site plan on file. A <br />new certified survey was submitted 4/2/92 indicating encroachment <br />into the City of Tonka Bay’s fire lane DUA. The new survey <br />confirmed that the slips on the west side are larger than those <br />shown on the 1977 survey. A side setback variance was granted <br />9/28/78 on the west side, addressing the encroachment into the <br />City of Tonka Bay’s fire lane DUA. Attorney James Penberthy. <br />representing Curly’s Marina, submitted a copy of the Tonka Bay <br />City Council minutes showing their approval of the encroachment. <br />He will supply a certified copy. <br />The new survey also shows a 10’ section of dock including <br />slip #132 on the far eastern dock structure extends beyond 200’. <br />According to Attorney LeFevere the dock is eligible for grandfa­ <br />thering if it existed when it was licensed with the exception of <br />the portion which extends beyond 200’. This 10’ section is shown <br />within the 200’ line on the 1977 survey. This section, according <br />to the owner Gordon Koch is an integral part of the dock struc­ <br />ture.
