and shall classify each system as Code, Conforming, or Non <br />conforming. <br />1. Right of Entry; The City Inspector shall <br />have the right of entry onto every property in the City, which <br />property includes an on-site system, for purposes of inspecting <br />said system for conformity with the provisions of this Section. <br />Each construction permit issued after adoption of this Section <br />shall extend the right of entry to the City Inspector by explicit <br />approval of the owner requesting such permit, which approval may be <br />filed in the chain of title for the property. Failure of any party <br />to grant the City access for this purpose shall be grounds to <br />classify any system on the property as Non-Conforming. The City <br />Attorney shall tnereafter take such action as is necessary to <br />enable the City to perform the Inspection and to enforce axl the <br />provisions of this Section, and to assess the cost thereof against <br />the property. <br />2. Inspection Report. Within thirty (30) days <br />after the inspection of each system by the City, the City shall <br />provide the results of said inspection in writing to the owner of <br />the system, including the classification of the system as to <br />conformance with City requirements and potential for existing or <br />future problems. Notice of non-conforming or failing systems shall <br />include orders for maintenance, repairs or replacement, the <br />procedures for obtaining all required permits, the deadline for <br />completion of the construction or pumping and the penalties for <br />failure to comply with the order. <br />3. Code and Conforming Systems shall be <br />Inspected by the City at least once every two years. <br />4. Owners of Non-Conforming Systems shall be <br />issued orders requiring maintenance, repair, alteration or replace <br />ment. Systems found to be non-conforming shall be brought up to <br />conforming status per Sub ivision 5 (c) within one calendar year <br />from the date of the order. Systems found to be non-conforming due <br />to failure or pollution hazards shall have remedial action required <br />within a reasonable period of time as follows: <br />(a) Sewage tanks requiring pumping shall <br />be pumped within 48 hours. <br />(b) Sewage tanks or systems found to be <br />clogged, overflowing, leeching or otherwise discharging pollutants <br />shall be pumped within 48 hours and thereafter as needed and the <br />system shall be repaired, altered or replaced within 90 days. <br />5. Systems required to obtain and maintain a <br />MPCA State Disposal System shall meet the requirements of MPCA <br />Rules Chapter 7080.0030. If the State Permit lapses, orders shall <br />be issued to cease use of the system within ten (10) days, such use <br />to be discontinued until reinstatement of the State Permit. <br />6. Failure to obey a lawful order requiring <br />repair, alteration or replacement of a Non-Conforming System shall
