be cause for the City to enjoin the owner or occupant from further <br />use of the system. Upon notice, the owner shall nave ten (10) days <br />to show cause to the City why the property should not be condemned <br />for occupancy according to Minnesota Statutes 463.15 et.seq. <br />C. Annual Service Charge. An annual ser’^ice charge <br />In the amount prescribed by resolution of the Council shall be paid <br />by the owner of every building connected to an on-site system, such <br />charge for purposes of administering and enforcing the City <br />Inspection Program as provided for herein. A separate charge shall <br />be due for each separate system located on each property. <br />1. The service charge shall be due 45 days <br />after the billing date. <br />2. It shall be the duty of the City <br />Administrator to endeavor to collect all delinquent accounts. <br />3. Each year the City Administrator shall <br />prepare an assessment rol’ providing for the assessment of the <br />delinquent accounts against the respective properties as pro\ ded <br />In Minnesota Statues 429.061, Subdivision 3, and shall certify same <br />to the County Auditor who shall thereupon enter such amount with <br />the tax levy on said property collectible with the taxes for the <br />next year. <br />D. (Codifier's Note: Contractor licensing <br />requirements covered in City Code Chapter 5.) <br />Subd. 9. Enforcement; Violation. <br />A. Enf orc''ment. It shall be the duty of the <br />Building Official to enforce the provisions of this Section and to <br />bring to the attention of the prosecuting attorney any violations <br />or lack of compliance herewith. <br />B. Civil Enforcement. Appropriate actions and <br />proceedings may be taken by law or in equity to prevent any <br />violation of the provisions of this Section to prevent unlawful <br />construction, to recover damages, to restrain, correct or abate a <br />violation, to prevent illegal occupancy of a building, or to <br />prevent continued use of a non-conforming on-site system. <br />Subd. 10. Severability. If any provision of these <br />standards or the application thereof to any person or circumstances <br />is held to be Invalid, such Invalidity shall not affect other <br />provisions of these standards or application of any other part of <br />these standards which can be given effect without application of <br />the invalid provision. To this end the provisions of all sections, <br />subsections, or subdivisions herein and the various applications <br />thereof are declared to be severable. <br />BBCnOM 5. Effective Date. This ordinance shall be effective upon <br />publication.
