n <br />fr <br />feystews" shall become "existing systems" at the time of final <br />Inspection and approval by the City. <br />(c) System Conformity Definitions: <br />i. "Code System" - A system which meets <br />all the location, design and construction standards of the current <br />City Codes, and which is operating satisfactorily by treating and <br />disposing of the entire current sewage input without discharging <br />any pollutants into ground or surface waters. <br />ii. "Conforming System" - A system which <br />does not meet all the location, design and construction standards <br />of the current City Codes, but was installed according to the code <br />in effect at the time of installation, and which is operating <br />satisfactorily by treating and disposing of the entire current <br />sewage input without discharging any pollutants into ground or <br />surface waters. <br />iii. "Non-Conforming System" - A prohi <br />bited system; a system located within a designated 100-year <br />floodplain; any system which may or may not meet all the location, <br />design or construction standards of the current City Codes and <br />which is failing for any reason; and any system with less than 3 <br />feet of unsaturated soil or sand between the distribution device <br />and the limiting soil characteristics. <br />iiii. "Failing System" - Any system which <br />is being used beyond its capacity or for any other reason has <br />failed to treat properly and/or dispose of the entire current input <br />and is therefore: <br />(1) Discharging pollutants, or any <br />liquid, to the surface of the ground or the ground water or to any <br />lake, stream or other body of water; or, <br />(2) Not accepting sewage input from an <br />occupied building; or, <br />(3) Creating a safety hazard due to <br />unprotected or improper construction or maintenance; or, <br />(4) Creating a public nuisance in any <br />manner. <br />11. "Owner" - Any person having legal or equitable <br />title or sufficient proprietary interest in any building or land <br />subject to the provisions of this Section. For purposes of <br />notification, the owner shall be the occupant of the property or <br />the person listed as taxpayer on the current tax rolls. <br />12. "Pollutants" - Bacterial or chemic 1 impurities <br />including pathogenic bacteria, infectious viruses, toxic chemicals, <br />excess nutrients (nitrogen and phosphorous), unpotable water, or <br />septage . <br />13. "Privy" - An outhouse, a c<^sspool enclosed by a <br />building, typically not served with running water. <br />14. "Pumping" - The removal by gravity, syphon or <br />mechanical means of any liquid or septage from sewage or holding <br />tanks .
