A RESOLUTION VACATING AN <br />UNUSED PORTION OF FOREST BOULEVARD <br />WITHIN THE PLAT OF SAGA HILL REVISED, <br />SECTION 7, TOWNSHIP 117, RANGE 23 <br />IN THE CITY OF ORONO, MINNESOTA <br />WHEREAS, the City of Orono is a municipal coq)oration organized and existing <br />under the laws of the State of Minnesota; and <br />WHEREAS, on May 27, 1988, Thomas David Regnier and Jane Best Regnier, <br />1205 Elmwood Avenue, filed a petition with the City of Orono requesting the vacation of a <br />portion of Forest Boulevard originally dedicated in the Plat of Saga Hill Revised legally <br />described as follows: <br />That part of vacated Forest Boulevard as dedicated in the plat of <br />"Saga Hill Revised, Hennepin Co. Minn." which lies between the <br />westerly e.xtensions across it of the northerly rnd southerly lines <br />of Lot 1, Block 5. "Saga Hill Revised, Hennepin Co. Minn." <br />WHEREAS, after due published and posted notice, public hearings were held <br />before the City Planning Commission on June 20, 1988 and March 15, 1993, regarding said <br />vacation and all interested persons were given opportunity to be heard; and <br />WHEREAS, after due standing and consideration, the Planning Commission <br />recommended approval of the requested vacation and the Council of the City of Orono finds that <br />said vacation as proposed, is in keeping with the public interest in consideration of the following <br />findings: <br />1. <br />2. <br />3. <br />The vacation does not affect the access or the use of adjoining properties. <br />The City has not and does not intend to deve'op, improve, or use the dedicated <br />right-of-way or Forest Boulevard for road purposes. <br />The Ciiy has not and does not intend to maintain or install utilities within the <br />dedicated right-of-wav of Forest Boulevard. <br />W 0 <br />Page 1 of 2
