Mabusth, Building & Zoning Administrator <br />April 5. 1993 <br />#1298 Vacation of Forest Boulevard - Resolutions <br />4^ <br />% <br />% <br />Brief Review and Planning Commission Recommendation <br />The Planning Commission unanimously approved the vacation petition of the seven <br />property owners as specific areas o^* vacated right-of-way would have no impact on the Gordon <br />Nelson property. Richard Johnson, the resident who prepared and filed the comprehensive <br />vacation application for the ten rc.i.aining property owners, voiced major concern with the five <br />year delay by the City in deiemiining how Mr. Nelson’s access issne was t be resolved. <br />In the last five years the City has attempted to work with adjacent propeny owners to <br />achieve comprehemive access but all attempts failed. The City considered more complex legal <br />procedures such as rescinding original vacation of Oak Place because the original vacation did <br />not follow required State procedures. This approach was final* ' dropped because of the impact <br />on me many property owners involved. It is hoped that by your meeting the City will be able <br />to provide clear direction as to a recommended procedure for acquiring access for both the City <br />and Mr. Nelson. <br />Based on the approval recommendation of the Planning Commission, seven vacation <br />resolutions have been prepared. Hach of the individual propeny owners w'ill be asked to file the <br />resolutions against the Chain of Title of each of the properties. <br />Isv
