Asst. <br />March 3. 1993 <br />Lakeside Marina - In/Out Launching Issues <br />Planning & Zoning Administer <br />•>2'' <br />^ ^ % <br />% <br />% <br />The attached letter to Lakeside Marina from LMCD dated February 19th discusses the issue of <br />in/out watercraft launching. LMCD is advising that they will not allow such use. and expects <br />the marina to document compliance by submitting records, etc. <br />Mr. Dunn has asked staff to forward this letter to Council, requesting the City to take a position <br />on this matter. I advised him I would place it on the March 8th agenda, ai.J further advised him <br />that if in fact this use does occur, the City will have concerns regarding compliance with code <br />requirements for parking as well as issues related to dry stack use. <br />Note that Section 10.41. Subd. 5(A) requires six parking spaces provided for each ten boat slips <br />"on water or on land". Section 10.41, Subd. 8(1) indicates that "if outside boat slip (land) <br />storage facilities are provided, the boats shall be stored in such manner that they do not create <br />a fire hazard. Any outside structures for purpose of storage of boats may not exceed 15’ in <br />height. Dry boat storage areas may not be located in the required yards or landscaping areas <br />The other code section which may come into play is Subd. 12. Non-conforming Use. which in <br />item A indicates that "any marina operator who increases the number of boat slips, ^at buoys <br />or overall length ot docks beyond what he was previously licensed for by the City, which <br />increases are authorized by ordinances of the Lake Minnetonka Conser\’ation District, shall first <br />decrease an equivalent number of boat slips or boat buoys and eliminate an equivalent length of <br />dock from that portion of his diKk that is non-conforming under the terms of Ordinance No. 1 <br />of the LMCD. . ." This is the only section of our code which even inkles the type of water-slip- <br />for-dry-stack-slip trade-off scenario that appears in our dry slack agreement with North Shore <br />Drive Marina. <br />Please advise staff as to any response to Mr. Dunn regarding this ijsue.
