I) <br />J) <br />The Council finds that granting of the proposed lot <br />area variance will not in any way impair health, <br />safety, comfort, morals, or in any other respect be <br />contrary to the intent of the code. A strict <br />enforcement of the minimum lot area of 2 acres in <br />each of the two proposed lots under the above noted <br />circumstances unique to the property would cause <br />applicant "undue hardship". <br />The guiding principals of the land use regulations <br />of Orono are the avoidance of excessive intensive <br />land development and the threat to public health <br />which occurs with excessive crowing of private <br />sewage disposal systems on substandard building <br />sites, as stated in Municipal Code Section 10.01. <br />The City recognizes chat the creation of larger lot <br />sizes in unsewered areas is m.andatory and that on <br />site disposal systems must not be allowed on any <br />site of less than 2 acres. Juxtaposed on the <br />concerns over private sewage disposal systems is <br />the "urbanization spiral" that results from the <br />rapid extension of municipal sewer services into <br />rural areas. The resulting "development paradox" <br />is of paramount concern to the public and is a <br />primary factor of the formulation of land use <br />policy in Orono. <br />The Council would not adversely affect Che spirit, <br />purpose and intent of the code in the RR-IB <br />classification by granting the applicant's request <br />for a lot area variance. Granting the variance <br />request would provide a basis to allow the property <br />to be subdivided into two lots, a 1 acre lot for <br />the existing sewered residence and a 2* acre new <br />unsewered building site. The new building site <br />would meet all of the current zoning regulations of <br />the RR-IB District, including all City on-site <br />sewage treatment requirements. Granting the <br />variance request does not create any new, <br />substandard building sites. <br />Page 4 of 9
