The property is the only property within "housing <br />cluster 5" which meets the RR-IB lot area <br />requirements. All other lots in "housing cluster <br />5" are substandard with respect to lot area. <br />3) <br />On August 11, i980 the City Council adopted <br />Resolution #1178, determining that one sewer <br />service stub be provided to serve the existing <br />residence on the property, provided that any future <br />subdivision on the property must leave not less <br />than 1 acre for the existing residence, and any new <br />lot created in the future will fully comply with <br />current zoning regulations at the time of <br />subdivision, and comply with all City on-site <br />sewage treatment requirements. <br />The applicant relied on Resolution #1178 when he <br />granted the City of Orono an easement for placement <br />of a sewer lift station at the east end of the <br />property, which was necessary for the sewering of <br />the Minnetonka Bluff's area. Applicant did not <br />insist on monetary consideration for granting this <br />easement not only because he wished to provide real <br />support to the sewer project in this area, but also <br />as a result of his reliance on the spirit and <br />intent of Resolution #1178. <br />In 1981 the City Council extended the MUSA boundary <br />line to include the sewer serviced portions of <br />"housing cluster 5", said line being located to <br />include only the easterly sewer serviced portion of <br />the property. <br />The defacto Council approval of conditions for a <br />future subdivision in Resolution #1178 and the <br />subsequent placement of the MUSA boundary line <br />through the interior of the property rather than <br />along an existing lor line, are conditions unique <br />to the property and generally not found on other <br />properties within the City. <br />Page 3 of 9
