4. The City Coi*ncil reviewed this application on December <br />14, 1992 and considered the recommendation of the <br />Planning Commissic'n, reports by City staff, verbal and <br />written comments by the applicant and his attorney, and <br />the effect of the proposed variance on the health, safety <br />and welfare of the commu)*.ity. On December 14, 1992, the <br />City Council voted 3 in favor, 1 against, with 1 <br />abstention, to gr-jit approval of the variance as <br />requested by the ;.pplirant and direct staff to draft a <br />resolution for approval. <br />5. The City Council makes the following findings of fact <br />pertinent to this variance request: <br />A) The area of the property is approximately 3.66 <br />acres in total area, wirh approximately 3.01 acres <br />net contiguous dry buildable exclusive of 33' of <br />right-of-way for Orono Orchard Road, exclusive of <br />designated wetlands, and exclusive of a non­ <br />contiguous strip located across County Road 15. <br />B) Applicant's existing residence is located in the <br />eastern one-third of the 3.01 acre parcel, is <br />currently served by public sewer as a result of the <br />City's Sewer Project 80-1 and lies within the <br />Metropolitan Urban Service Area (MUSA). The <br />westerly two-thirds of the property lies outside <br />the MUSA, and is not provided with municipal sewer, <br />having been excluded from Sewer Project bO-1. <br />C) The contiguous dry buildable portion of the <br />property is located in the RR-IB Zoning District, <br />requiring 2.0 acres of dry buildable land per <br />building site, per Municipal Code Section 10.28, <br />Subdivision 5 (B). <br />D) The City of Orono initiated Sewer Project 90-1 in <br />part to solve existing on-site sewage treatment <br />problems in the Minnetonka Bluffs area ("housing <br />cluster 5" as shown on Map 12 of the 1980 Community <br />Management Plan) in which the property is located. <br />Page 2 of 9
