I <br />A RESOLUTION GRANTING <br />A VARIANCE TO <br />MUNICIPAL ZONING CODE <br />SECTION 10.28, SUBDIVISION 5 (B) AND MUNICIPAL <br />SUBDIVISION CODE SECTION 11.10, SUBDIVISION 14 <br />FILE #1778 <br />WHEREAS, Andrew J. Goetten (hereinafter "the applicant") <br />is owner of the property located at 1385 Fox Street within the City <br />of Orono (hereinafter "City" ^.nd legally described as follows: <br />Exhibit A attached (hereinafter "the property"); and <br />WHEREAS, the applicant has applied to the City for a <br />variance to Municipal Zoning Code Section 10.^3, Subdivision 5 (B) <br />and Municipal Subdivision Code Section 11.10, Subdivision 14, to <br />perr’''t the subdivision of the property into two building <br />of which will not meet the minimum 2 acre buildable area <br />reguirement of the RR-IB Zoning District. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of <br />Orono, Minnesota: <br />1. <br />2 . <br />3 . <br />FINDINGS <br />This application was reviewed as Zoning File #1770. <br />The property is located in *he RR-IB Rural Residential <br />Zoning District, requirin-j 2 acres of contiguous dry <br />buildable land in each building lor per Municipal Code <br />Section 10.28, fubdivision 5 (B) . <br />The Orono Planning Commission reviewed this application <br />on November 16, 1992 and on a vote of 6 in favor. 0 <br />aqainst, recommended that the property, comprising ]ust <br />over 3 acres in contiguous dry buildable area, be rezoned <br />to a 1 acre standard in conjunction with a general <br />rezoning of the surrounding "Minnetonka Bluffs" area, so <br />that the proposed lot area variance will no longer be <br />necessary. <br />Page 1 of 9
