Streep*,- ^ ^ X Lot Area Variance/Preliminary Subdivision ^ ^ 9 A> <br />Resolutions ^ ^^ <br />List o£ Exhibits <br />A - Variance Resolution <br />B - Preliminary Plat Aoproval Resolution <br />C - Council Minutes 12/14/92 <br />D - Council Action Notice 12/17/92 <br />Discussion <br />At the December 14th Council meeting, Council voted 3 in <br />favor, 1 against, 1 abstention, to approve the granting of a lot <br />area variance and preliminary plat approval as proposed by the <br />applicant, directing staff to draft resolutions reflecting said <br />approvals. <br />Two resolutions have been drafted. The lot area variance <br />approval resolution incorporates the Council's majority vie'^rpoint <br />that the 1980 resolution was in effect a contract, and includes the <br />hardships and unique circumstances as outlined by applicant's <br />attorney in the letter of request. <br />The preliminary plat approval resolution incorporates the <br />seven conditions of approval indicated by Council, but includes no <br />discussion regarding Council's decision to not require the standard <br />road dedications which would normally be required for a plat of <br />this nature. <br />Staff Recommandation <br />Staff is on record as opposing the granting of the lot area <br />v^jfi3fjce associated with a subdivision for reasons noted in the <br />staff memo of November 9, 1992. The attached resolutions, however, <br />have been drafted to reflect and provide a supportive basis for the <br />Council action of December 14th. <br />A4t
