Box 164 <br />Crystal Bay, MN 55323 <br />rjAN' e 1993 <br />Dear Mayor Peterson: <br />REVIEW AND COMMENT ON CITY OF MINNETONKA'S REQUEST FOR FLEXIBILITY <br />FROM STATE OF MINNESOTA'S SHORELAND MANAGEMENT STANDARDS <br />As required by the statewide shoreland management standards, the <br />Comnissioner of the Minnesota Department of Natural Resources (DNR) <br />and the City of Minnetonka are hereby notifying your city of <br />Minnetonka's request for ilexibility from the statewide standards <br />as outlined below. In accordance with the rules, the Commissioner <br />and the city must solicit the input and approval of other <br />governmental bodies that could be affected or impacted by the <br />alternate controls. The city and the DNR are asking that you <br />pr'ovide your review and comments, if any, to either DNR or the city <br />within 45 days of the date of this letter. If no response is <br />i^aceived prior to then, we will assume that your .. * -y has no <br />concerns with the neighboring city's proposal. <br />The City of Minnetonka is requesting flexibility from the following <br />statewide standards: <br />1.Increase in the structure height limit. Statewide <br />standards require that a 25 foot height limit be app3ied <br />to all new structures in residential land use districts <br />in cities. The city is requesting the use of flexibility <br />to all<^w structures a height limit of 3 5 feet in <br />residential land use districts, to keep many existing <br />residences already constructed above the 25 foot limit <br />from becoming nonconforming structures. The maximum <br />allowable structure height under the "old" state <br />shoreland rules was 35 feet. <br />2.Reduction in lot size for duplex, triplex, and quad <br />residential development. The city requires a minimum lot <br />size of 22,000 square feet for riparian lots and 15,000 <br />square feet for nonriparian lots for lots of record <br />created before February 12, 1966 for both Recreational <br />Development and Cenoral Development lakes.
