city of Min.'etonka Flexibility Request <br />January 4, 1993 <br />Page (2) <br />DNR standards for Recreational Development lakes is <br />20,000 and 15,000 square feet for new riparian and <br />nonriparian lots and new lot sizes of 15,000 and 10,000 <br />square feet for riparian and nonriparian lots in General <br />Development shorelands. The city notes that there are not <br />many existing undevelopea single lots in either the <br />Recreational or General Development shorelands that do <br />not comply with DNR's minimum single family lot sizes. <br />The city is requesting flexibility to reduce the minimum <br />lot sizes for duplex, triplex, and quad developments from <br />the minimum DNR standards. The city standards require <br />minimum riparian lot sizes of 25,000 square feet for <br />duplexes and 30,000 square feet for triplexes and quads <br />and minimum nonriparian lot sizes of 20,000 for duplexes <br />and 10,890 square feet for duplexes and triplexes. The <br />city and the developer usually agree on larger lane' areas <br />for these type of developments but the individual <br />buildings when platted are often less than the required <br />lot area to allow for individual home ownership of units <br />with common open space provided within the development. <br />The average lot size of the development as a whole <br />generally meets the shoreland rules. <br />3. Reduction of the setback requirement for accessory <br />structures and decks. The city is asking for flexibility <br />to allow setbacks for accessory structures and decks to <br />be allowed no closer than 35 feet and 25 feet <br />respectively. The statewide standards require that <br />accessory structures be setback the same distance as the <br />principal structure and decks cannot not be located <br />closer than 15% of the principal structure's setback or <br />a maximum of 30 feet landward of the ordinary high water <br />level of any public varars. The statewide rules also <br />allow water-oriented accessory structures to be located <br />within 10 feet of the ordinary high water level. The <br />city will no longer allow any water oriented accessory <br />structures closer than 35 feet from the ordinary high <br />water level to maintain equity for all riparian shoreland <br />property owners. <br />4. Relaxation of the statewide standards requiring that <br />impervious cover in the shoreland area be limited to 25%. <br />The city is requesting that it be allowed to increase the <br />impervious lioit up to 30% in the shoreland area located <br />within 150 fec't of the ordinary high water level. For <br />the remaining shoreland, impervious cover couM approach <br />75%. The rationale for this request is thdt the City of <br />Minnetonka is estimated to be 95% developed and
