6. <br />7. <br />8. <br />9. <br />10. <br />The proposed location of the storage module located 28’ from the County Road <br />15 right-of-way where a 30 ’ street yard is normally required, is a location that is <br />extremely visible from said road, and therefore visual screening of the module by <br />use of evergreen type vegetation is imperative to reduce the negative visual <br />impacts. <br />It is the clear intent of Municipal Code Section 10.41, Subdivision 7 (b) that <br />required landscape areas not be used for the storage of boats, equipment, or <br />materials, fhe proposed storage module will provide storage such tliat none of <br />the landscape areas per the approved site plan need be encumbered w ith storage <br />of any kind. <br />This propcny currently consists of two tax parcels. The boundary line between <br />the two parcels abuts parking stall #34. This leaves virtually no setback between <br />the parcel side lot line and the module. Technically this requires a side .setback <br />variance unless the two properties are legally combined. The properties should <br />therefore be combined. <br />The City Council has considered this application including the tindings and <br />recommendations of the Planning Commission, reports by City statt, comments <br />by the applicant and the effect of the proposed variance on the health, safety and <br />welfare of the community. <br />The City Council finds that the conditions existing on this property are peculiar <br />to it and do not apply generally to other property in this zoning district; that <br />granting the variance would not adversely affect traffic conditions, light, air nor <br />po.se a fire hazard or other danger to neighboring property; would not merely <br />serve as a convenieiKe to the applicant, but Is necessary to alleviate a <br />demonstrable hardship or difficulty: is necessary to preserve a substantial property <br />right of the applicant; and would be in keeping with the spirit and intent ot the <br />Zoning Code and Comprehensive Plan of the City. <br />CONCLUSIONS, ORDKR .AND CONDH IONS <br />Based upon one or nu>re of the findings noted above, the Orono City CouiKil <br />hereby grants the variances as set forth above and approves the installation of an 8 x 8 x 20 <br />Page 3 of 6
