Public Works Administrator <br />DATE:December 9. 1993 <br />2. <br />SUBJECT: Tax Forfeit Property Acquisition <br />At the November 22. 1993 Council meeting the Council was asked to review a large parcel ot <br />■anJ Uial was in tax lorfeiture to be released lor publie sale. The Council requested turther <br />consideration lor this parcel and asked staff to research the possibthty of the City aequirtng this <br />large a parcel. <br />I have checked with Hennepin County Department of Propeny Tax and Public Record and have <br />been advised on the following: <br />1 The City can acquire the land tree of charge if the land is acquired tor park <br />purposes. The only requirement is that the land must be used for park purposes. <br />Tliis action is usually approved by the County Board without delay. It the City <br />wishes to dispose of the land in the future, then it must be reconveyed to <br />Hennepin County for public sale. <br />Acquire the land without restricted use. The County would conduct an appraisal <br />of die ponienv (Orono s Assessor's market value $41.500) aruJ the City would <br />pay that amount. If County Board approves, we may have to explain intended <br />use of the property. There will also be costs of approximately $l .CKX) to clean up <br />tlie cloud on title as a result of tax forfeiture. <br />The third option would be for the HR.\ to acquire the land for a fee following the <br />appraisal process. This is usually approved by the County Biard with littx <br />difficulty because the County assumes that if you are to acquire land through an <br />HR.A. that you are going to use the propeny for housing. <br />This parcel was reviewed as a six lot subdivision in 1979. <br />This land in coniunction with other adjoining parcels was reviewed as a <br />subdivision in .ipproximately 1988. <br />At that lime ihc Park Commission deunmned that they would ik.i ^ <br />land for park purposes as the City had park land to ihe south ai llighwrxrd .Nature <br />Trails tl4 acres) and DNR owned the I uce Line to the nonh <br />The Park Commission hjs not reviewed this parcel at this lime. <br />3. <br />ch
