Mr. Holm stated that it would Le no problem to relocate the driveway if so desired. Mr. Oberhauser presented a petition from the neighbors indicating no objection to the proposal. Gerald Hagen was pi’esent. He stated he had no comments. After all the public were heard, the public hearing was closed at 8:35 p»ni. The Planning Commission continued discussion of the application. The Planning Commission determined that the proposed subdivision would be a remedy to the existing situation. Frahm moved, Hassel seconded, to recommend approval of the preliminary subdivision subject to access easements as necessary to eliminate possible access problems in the future. Motion - Ayes (6), Nays (O). Chairman McDonald annoimced this was the time and place for a public hearing on the petition of Conley Brook*- for a subdivision of property located at 1125 Spring Hill Road. The Zoning Administrator presented the Notice of Public Hearing and the Affidavit of Publication. Mr. Herfurth, representing Mr. Brooks, presented the preliminary subdivision proposal. Mr. Brooks is requesting approval to subdivide Tract A (part of original subdivision approved by Council this past August) into two i>arcels. Both parcels would exceed the minimum 2 acre and 200 ft. Tot width require ments. However, there is only one access for the two parcels and the driveway entering Parcel A-2 is partially located on Parcel A-1. The Zoning Administrator presented a copy of the letter from the City Engineer in which he i-ecommended that an easement be included to eliminate any possible legal problems. The City Engineer also noted that a garage located on Parcel A-1 is not showfi on t’ne preliminary plat. Mr. Herfurth commented that Mr. Brooks may consider moving the bam. After all the public were heard, the public hearing war. closed at 8:ii-5 p.m. Tlie Planning Commission continued to discuss the proposed plat. The Coimnission reviewed the report submitted by the Minnehalia Creek Watershed District indicating their concern for the marsh areas along the creek. Tlieir recommendation is to provide for i-etaining of these wetlands in their present state.
