A RESOLUTION TO APPROVE CONNECTION <br />TO MUNICIPAL SEWER OF THE PROPERTY LOCATED <br />AT 1940 SHORELINE DRIVE <br />WHEREAS, Alan Nettles (hereinafter the propeny owner) is owner of the <br />property, including single family residence, located at 1940 Shoreline Drive within the City of <br />Orono and legally described as follows: <br />The southwesterly 121.12 feet of Lot 5, Llbridge S. Barnes First <br />Addition, in Section 10, Township 117. Range 23, according to <br />the recorded plat thereof on file and of record in the office of the <br />Registrar of Titles, Hennepin County, Minnesota (hereinafter the <br />property); and <br />WHEREAS, on June 4. 1993 the applicant submitted a letter to the City <br />requesting that his property be allowed to connect to the municipal sewer which is located in the <br />right-of-way of County Road 15 approximately 20 feet from his southeasterly propeny comer; <br />and <br />WHEREAS, said municipal sewer line is pan of the City’s 1985-LS-l Crystal <br />Bay sewer lateral project, for which properties benefitting by such system were assessed for the <br />costs of said system; and <br />WHEREAS, the property at 1940 Shoreline Drive was not provided w ith a sewer <br />stub as pan of Project 1985-LS-l, it was not assessed for that project, and was not incorporated <br />within the MUSA boundary created for said project; and <br />WHEREAS, the applicant has made formal application to the City for a <br />Comprehensive Plan amendment to relocate the .MUSA boundary to include his property, which <br />amendment was approved by the City Council in Resolution #3348 on October 25, 1993. and! <br />approved by the Metroptilitan Council on November 4. 1993; and <br />W HEREAS. the property is located on the lakeshore of Lake .Minnetonka and <br />contains a single family residence with a failing septic system. The prop**rty is approximately <br />2.2 acres in area and includes wetlands, and therefore is not further .subdividable under the lot
