requirements of the LR-IA zoning district. A municipal sewer lateral e.xists approximately 20 <br />feet from the property, requiring no extension of the municipal sewer. The costs of replacing <br />the existing failing septic system with a fully conforming septic system approximate the costs <br />of the connection charge for the 1985-LS-l project plus the SAC charge and connection costs <br />to be borne by the property owner; and <br />WHEREAS, allowing the property to connect to the municipal sew'er will not be <br />in conflict with the goals and policies of the Orono Community Management Plan, in that no <br />extension of municipal sewer is required, no new high density development will occur as a result <br />of the MUSA boundar>' expansion, and Lake Minnetonka will be further protected by the <br />elimination of a failing septic system located on a lakeshore lot; and <br />WHEREAS, the applicant has requested that the current connection charge of <br />$11,218.00 be split into a portion to be paid prior to connection and a portion to be levied as <br />a special assessment, in proportions approximating those paid and remaining assessments of the <br />properties in the Crystal Bay project; and <br />WHEREAS, the City wishes to establish an easement for possible future sewer <br />construction which may occur on or in the right-of-way adjacent to the property. <br />NOW, THEREFORE, BE IT RESOLVED, by the City Council of Orono, <br />Minnesota that the property at 1940 Shoreline Drive shall be allowed to make connection to the <br />municipal sewer subject to the following conditions: <br />1 <br />2. <br />3. <br />Prior to making the connection, applicant shall pay to the City 8/15th’s of the <br />$11,218.00 connection charge or $5,982.91. The remaining $5,235.09 shall be <br />levied as a special assessment for a period of seven (7) years at an interest rate <br />of 9.20%. The effective date of this levy shall be November 22. 1993. <br />Applicant shall pay the current sewer availability charge and applicant’s <br />contractor sh.ill obtain a comiection permit prior to connecting to the municipal <br />sewer. <br />The method and liKafion of the connection, which will likely require installation <br />of a new ’ stub into the existing sewer line, shall be approved by the Public Works <br />Department prior to making such connection. Tfie applicant shall bear all costs <br />of making said connection and restoration of City right-of-ways, if required
