JOINT POWERS AGREEMENT <br />FOR PROSECUTION SERVICES <br />This agreement is between the City of Minnetonka <br />("Minnetonka") and the Cities of Minnetonka Beach, Minnetrista, <br />Orono, and St. Bonifacius (sometimes collectively referred to as <br />"Cities"), all of which are Minnesota municipal corporations with <br />the power to cooperatively exercise municipal powers pursuant to <br />Minn. Stat. §471.59. <br />1. Purpose. Each of the Cities and Minnetonka have the <br />power and responsiblity to prosecute criminal matters within their <br />respective jurisdictions. They wish to provide for the exercise of <br />such prosecutorial powers by Minnetonka on behalf of the Cities. <br />2. Provision of Services. Minnetonka shall provide all of <br />the personnel, office space, and supplies necessary to prosecute <br />the criminal offenses for which the Cities are responsible, <br />including enforcement of the Cities' codes of ordinances. In <br />addition, Minnetonka will provide legal advice and training <br />regarding criminal law to the Cities' departments which have law <br />enforcement and code enforcement duties. All personnel providing <br />these services will be Minnetonka employees, and Minnetonka will be <br />responsible for all employment matters related to these employees, <br />including employee benefits, workers' compensation, and <br />unemployment compensation. When hiring any attorney to perform <br />these services, Minnetonka will include a representative from each <br />of the Cities, at their option, in the interviews of the finalist <br />candidates. On occasion, Minnetonka may subcontract for assistance <br />from attorneys who are not Minnetonka employees. Minnetonka will <br />provide the identities of these individuals in advance to the <br />Cities. Personnel provided will consult with the Cities' elected <br />and appointed officials regarding policy and guidelines. <br />3. Fees. The Cities will <br />Minnetonka for calendar year 1994: <br />pay the following fees to <br />Minnetonka Beach <br />Minnetrista <br />Orono <br />St. Bonifacius <br />$ 2,068 per year <br />$20,678 per year <br />$31,017 per year <br />$ 7,237 per year <br />For calendar year 1996, these fees will be increased by the same <br />percentage increase granted by Minnetonka to its management <br />employees for 1995 wages. The fees will be paid in advance, on a <br />quarterly basis beginning December 31, 1993. Minnetonka will <br />notify each City in writing after the 1995 percentage increase has <br />been determined. If this notification occurs after January 1, <br />1995, each City will have 30 days after the notice to reimburse <br />Minnetonka for the increase retroactive to January 1, 1995. The
