The barns which exist meet the normal accessory structure set <br />backs, but not 150' or 75' setbacks for animal housing - so <br />animal housing would be allowed; also note that as non- <br />animal barn structures, both exceed the 1,000 s.f. maximum size for <br />such structures - this makes them non-conforming structures within a <br />new subdivision* The City has a few options: <br />a) Grant variances and conditional use permit to allow them to <br />be used for animals under existing location and size; <br />b) Grant variance to allow them to stay as non—animal housing, <br />oversize accessory structures; <br />c) Require demolition. <br />4. The existing house does not quite meet the 50' front setback <br />(0.71' short). <br />5. The location of the septic system serving the house is unknown, <br />but presumed to be generally north of the house. Testing for <br />drainfield sites is underway. <br />6. Lot 2 is entirely within the Orono school district. <br />IV. Discussion. <br />Neighbor Steven Weinstein alludes in his letter (Exhibit F) to a <br />requirement that the barns and farmhouse be razed prior to subdivision of <br />Outlot B. This was never a condition required by the City. As to the fact <br />that the structures and chattel on Lot 2 are an eyesore, I would leave this <br />to each Planning Commissioner to decide. Mr. Hollander has briefly <br />discussed with staff that he believes the well serving the farmhouse on Lot <br />2 18 polluted, but he has not approached staff for help in remedying the <br />problem. This a concern. <br />tbe lack of compliance with certain conditions of the original <br />subdivision, and given that the current applicant is attempting to resolve <br />all matters dealing with the estate, staff feels that conceptually, the <br />proposed subdivision is reasonable and desirable from a neighborhood <br />standpoint, but only under a number of conditions enumerated below. <br />V. Staff Recommendation <br />new <br />mid <br />luch <br />A recommendation for preliminary subdivision approval by the Planning <br />Commission would be appropriate if accompanied by the following conditions: <br />1. Rental house on Lot 1 must be removed within 6 months of City <br />Council's final plat approval.
