4. A gravity sewer line runs adjacent to the west lot line <br />of the property and the City has agreed to extend sewer <br />to the rural property. <br />5. Concurrent with the review of this subdivision, the City <br />also has filed for a minor Comprehensive Plan Amendment <br />that would allow the inclusion of this property within <br />the Metropolitan Urban Service Area. The hearing for the <br />Comprehensive Plan Amendment was held on August 16, 1993. <br />The sewering of this rural property will not result in <br />any change from the current two-acre rural zoning. <br />6. The rural residential lot is located within southern <br />basin of French Lake, a Natural Environment lake. <br />7. Access to the site shall remain via an existing gravel <br />driveway that currently serves an MWCC lift station <br />facility. <br />8. Outlot A shall remain as an open space area consisting of <br />the private gravel drive and future site for development <br />of a park. <br />NOW, THEREFORE, BE IT RESOLVED, that based upon one or <br />more of the findings noted above, the City Council of the City of <br />Orono hereby approves the preliminary plat of the property located <br />at 1000 Old Crystal Bay Road South per the survey dated January <br />18, 1990, revised August 12, 1993 by Mark S. Gronberg of Coffin and <br />Gronberg, Inc., subject to the following conditions: <br />1. Prior to the City granting final approval of the proposed <br />subdivision, the City must have received confirmation <br />from the Metropolitan Council that the residential lot <br />will be included within the Metropolitan Urban Service <br />Area and approved for sewer service. <br />2. The City of Orono shall assume the responsibility for the <br />regular maintenance of the private driveway. Future <br />owners of Lot 1, Block 1 shall [not] be responsible for <br />making payment to the City for their share in the regular <br />maintenance or repairs to the drive. <br />Page 2 of 4
