A RESOLOTION GRANTING PRELIMINARY <br />APPROVAL OF A PLAT OF THE PROPERTY LOCATED AT <br />1000 OLD CRYSTAL BAY ROAD SOUTH <br />- FILE NO. 1780 <br />WHEREAS, the City of Orono, on July 19, <br />formal subdivision application seeking approval <br />residential plat of property legally described as: <br />1993, <br />of a <br />filed a <br />one-lot <br />refer to Exhibit A, attached (hereinafter "the <br />property"); and <br />WHEREAS, after due published and mailed notice in <br />accordance with Minnesota Statutes 462.358 et. seq. and the City of <br />Orono's Zoning and Platting Codes, the Orono Planning Commission <br />held a public hearing on August 16, 1993, at which time all persons <br />desiring to be heard concerning this application were given the <br />opportunity to speak thereon; and <br />WHEREAS, at their regular meeting held on August 23, <br />1993, the Orono City Council considered the subdivision application <br />as proposed, noting the following findings of fact: <br />1. The property is located within the RR-IB, Rural <br />Residential Zoning District requiring a minimum of two <br />acres of contiguous dry buildable land within each newly <br />created lot. <br />2. The property contains approximately 36.7 acres of land, <br />13.75 acres consists of dry contiguous land. The <br />proposed plat contains one residential lot exceeding the <br />two acre minimum lot area requirement consisting of 4+ <br />dry contiguous acres. <br />3. Per a report by Steven B. Schirmers, an MPCA certified <br />site evaluator, dated May 24, 1993, has confirmed the <br />site can only support a principal alternate site for a <br />four-bedroom home. The site is incapable of supporting <br />a second alternate site. <br />Page 1 of 4
