A RESOLUTION GRANTING <br />A VARIANCE TO <br />MUNICIPAL ZONING CODE <br />SECTION 10.28, SUBDIVISION 5 (B) <br />FILE /j?1835 <br />WHEREAS, David S. Phelps and Ellen D. Phelps (hereinafter "the applicants") <br />are owners of the property located at 1950 Fox Ridge Road within the City of Orono (hereinafter <br />"City") and legally described as follows: <br />Lot 6, Block 1, Fox Ridge, Hennepin County, Minnesota (hereinafter "the property"); <br />and <br />WHEREAS, the applicants have applied to the City for a variance to Municipal <br />Zoning Code Section 10.28, Subdivision 5 (B) to permit a 13.2x22.6 addition to the street side <br />of the existing residence. It will be located 24.4’ from the front/street setback line where the <br />existing structure is 35.5 ’ and where the code requries a 50 ’ setback. <br />Minnesota: <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br />FINDINGS <br />1. This application was reviewed as Zoning File #1835. <br />2. The property is located in the RR-IB, Rural Residential Zoning District requiring <br />2 acres in area. The property consists of approximately 1 acre. <br />3.The Orono Planning Commission reviewed this application on June 21, 1993, and <br />recommended approval of the proposed variance based upon the following <br />hardships and findings: <br />Page 1 of 5
