r <br />A RESOLUTION GR*ANTING A VARIANCE <br />TO MUNICIPAL ZONING CODE <br />SECTION 10.27, SUBDIVISION 5 (B) <br />FILE NO. 1956 <br />WHEREAS, Thomas R. Smieja and Christina M. Smieja (hereinafter "the <br />applicants") have an interest in the property located at 4040 Watertown Road within the City of <br />Orono and legally described as follows: <br />refer to Exhibit A, attached (hereinafter "the property"); and <br />WHEREAS, the applicants have applied to the City for variances to Municipal <br />Zoning Code Section 10.27, Subdivision 5 (B) to permit construction of a 26’ x 48’, 2'/i story <br />addition to the east side of the existing residence and a 16’ x 14’ single story, three-season porch <br />to the west side to be located 25 ’ from the side street lot line instead of the required 100’ and <br />45’ from the side lot line where a 50’ setback is required. <br />Minnesota; <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br />FINDINGS <br />1. This application was reviewed as Zoning File #1956. <br />The property is located In the RR-IA Single Family Residential Zoning District <br />requiring 5 acres in area. The property consists of 1.28 acres exclusive of <br />adjacent public right-of-ways. <br />3.The Orono Planning Commission reviewed this application on August 15, 1994 <br />and recommended approval of the variances as proposed, based upon the <br />following unique findings and hardships: <br />A. The property is 1.2 acres in area and subject to 5 acre zoning standards. <br />B. The property is of an unusual triangular shape. <br />Page 1 of 5
