r <br />c.The residence has existed on this property for over 45 years and does not <br />meet the current setback standards for the RR-IA zoning district. <br />D.There's adequate septic capacity to serve the proposed improvements and <br />adequate area for a future alternate septic site on this severely limited <br />property. <br />4.The City Council finds that the conditions existing on this propeny are peculiar <br />to it and do not apply generally to other property in this zoning district; that <br />granting the variances would not adversely affect traffic conditions, light, air nor <br />pose a fire hazard or other danger to neighboring property; would not merely <br />serve as a convenience to the applicant, but is necessary to alleviate a <br />demonstrable hardship or difficulty; is necessary to preserve a substantial property <br />right of the applicant; and would be in keeping with the spirit and intent of the <br />Zoning Code and Comprehensive Plan of the City. <br />5.The City Council has considered this application including the findings and <br />recommendations of the Planning Commission, reports by City staff, comments <br />by the applicant and the effect of the proposed variance on the health, safety and <br />welfare of the community. <br />CONCLUSIONS, ORDER AND CONDITIONS <br />Based upon one or more of the findings noted above, the Orono City Council <br />hereby grants variances to Municipal Zoning Code Section 10.27, Subdivision 5 (B) to permit <br />the construction of a 26 ’ x 48’, 2*/i story east side addition and the 16 ’ x 14’ single story, three- <br />season porch west side addition approving a side street setback variance of 75’ or 75% and a <br />side variance of 5’ or 10%, subject to the following conditions; <br />1.The existing septic system and areas to south of septic system must be fenced off <br />prior to any land alterations or constmction activities at this property. <br />2.Applicant must obtain a demolition permit from the City prior to removal of the <br />detached garage. Garage must be removed prior to the final inspection by the <br />Orono Building staff for the new construction. <br />Page 2 of 5
